Arboleads Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Arboleads platform, website, and services (“Platform”). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance Of Terms

These Terms form a legally binding agreement between you and Arboleads. “You” refers to any Business User (a tree service company or professional) or End Customer accessing the Platform. Business Users who accept these Terms on behalf of a company represent they have authority to bind that company.

2. Description Of Services

Arboleads provides a web-based platform for tree service professionals that includes:

  • Estimate generation tools
  • Job and customer data management
  • Business reporting and analytics
  • Industry insights derived from aggregated platform data

We reserve the right to add, modify, or discontinue features at any time with reasonable notice.

3. Accounts And Registration

  • You must provide accurate, current, and complete information when registering.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized account access 
  • Accounts are for business use only and may not be shared or transferred without our written consent.

4. Data Use And Aggregated Insights

By using the Platform, you acknowledge and agree to the following:

You retain ownership of the specific business data and customer records you enter into the Platform.

4.2 License To Arboleads

You grant Arboleads a non-exclusive, worldwide license to use, process, and analyze the data you submit for the following purposes:

  • Operating and improving the Platform.
  • Generating aggregated, anonymized industry reports and insights that may be offered commercially.
  • Compiling statistical analyses, benchmarks, pricing trends, and market data.

4.3 Aggregation and Monetization

You expressly acknowledge and consent that Arboleads may:

  • Combine your data with data from other users in anonymized, aggregated form.
  • Create, license, or sell industry reports and insights derived from aggregated data.
  • Use anonymized platform data for commercial purposes, provided no individual or specific business can be identified.

Arboleads will never sell, share, or disclose your raw data, personal customer records, or identifiable business information to third parties.

5. Business User Obligations

As a Business User, you agree to:

  • Use the Platform only for lawful business purposes.
  • Obtain any required consent from your customers before entering their personal information into the Platform.
  • Inform your customers that their data may be processed by Arboleads per our Privacy Policy.
  • Not input sensitive data such as Social Security numbers, financial account numbers, or health information.
  • Not use the Platform to harass, spam, or engage in any unlawful conduct toward customers.
  • Comply with all applicable laws, including those governing data privacy and consumer protection.

6. Prohibited Uses

You may not:

  • Attempt to reverse engineer, scrape, or extract data from the Platform.
  • Use the Platform to transmit malware, spam, or harmful content.
  • Misrepresent your identity or business.
  • Access another user’s account without permission.
  • Use the Platform in any way that violates applicable local, state, or federal law.
  • Resell or sublicense access to the Platform without written consent from Arboleads.

7. INTELLECTUAL PROPERTY

All Platform software, design, trademarks, logos, and content created by Arboleads are the exclusive property of Arboleads and are protected by applicable intellectual property laws. Aggregated industry reports and data products created by Arboleads are the intellectual property of Arboleads. You may not copy, reproduce, or distribute our content without written permission.

8. Fees And Payment

Certain features of the Platform may require a paid subscription. Fees, billing cycles, and payment terms will be presented at the time of purchase. We reserve the right to change pricing with 30 days’ notice. All fees are non-refundable unless otherwise stated.

9. Disclaimer Of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ARBOLEADS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT OR DATA ON THE PLATFORM.

10. Limitation Of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ARBOLEADS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM, INCLUDING LOST PROFITS OR DATA LOSS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO ARBOLEADS IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Arboleads, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third party’s rights; or (d) your failure to obtain proper consent from customers whose data you enter into the Platform.

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including intellectual property, disclaimers, and limitations of liability.

13. Governing Law And Disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Illinois. You waive any objection to jurisdiction or venue in those courts.

14. Changes To Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days’ notice of material changes via email or platform notification. Continued use of the Platform after changes take effect constitutes your acceptance of the new Terms.

15. Entire Agreement
